These are the terms and conditions which apply to all purchases of books, e-books, maps and bags offered by Wild Poland. Please read them carefully as by purchasing the mentioned goods at Wild Poland you will be bound by them.
In these Terms & Conditions, ‘you’ and ‘your’ mean the person and company named in the billing details of the checkout form. ‘We’, ‘us’, ’our’ and ‘Company’ mean Wild Poland.
1. General Terms & Conditions
1.1 Introduction
Wild Poland website and services are provided by Wild Poland Sp. z o.o. whose registered office is located at: ul. Czardasza 18/14, 02-169 Warsaw, Poland. Registration number (KRS): 0001068932, company number (REGON): 526932239.
We may amend these Terms and Conditions at any time by posting of the amended Terms and Conditions on our website (https://wildpoland.com).
1.2 Contract Conclusion
If you submit an online order to buy books, e-books, maps and bags via our website (https://wildpoland.com) by clicking ‘Place order and pay’, your order is an offer to us to buy the goods on our website under these Terms and Conditions.
We will send you an automatically generated e-mail accepting your order. The contract comes into existence when we have received cleared funds in full payment for the goods you ordered. The contract will relate to only those goods which are referred to in our e-mail confirmation of acceptance of your order. You should read and check these details carefully to ensure that they are correct. If the details are not correct, please contact us immediately via email.
The contract language is English.
1.3 Availability and Delivery
Information displayed on the website relating to availability is subject to change without notice. We cannot guarantee permanent or continuous availability of all products on this site. All orders are subject to availability at all times.
1.4 Liability
Should the print or merchandise goods that Wild Poland delivers be defective, damaged, not what you ordered, or of incorrect quantity then you have a statutory right to cancel with refund of monies paid. You must notify us in writing within fourteen (14) working days after receiving your goods, beginning with the day after receiving your goods.Unless you notify us in writing within seven working days of receipt of goods Wild Poland will hold no liability. Upon notifying Wild Poland under this condition our only obligation will be to supply any shortfall of goods on a delivery or non-delivery, to replace or repair faulty or damaged items; or to refund you the amount paid for the goods in question to the original method of payment.
Wild Poland will where possible ensure that the availability of Wild Poland services will be un-interrupted and remain error-free. Due to the nature of the internet this cannot be guaranteed but we will do our utmost to restrict access for repairs, maintenance or site updates infrequently and for short durations. It is your responsibility to implement appropriate IT security safeguards (including anti-virus checks) to satisfy your particular requirements as to the safety and reliability of using the website.
Wild Poland does not warrant that the material on the website is completely accurate and will have no liability in respect of such material. Information regarding goods and their availability is subject to publisher information and stock levels.
Nothing in these terms will affect any liability we have: (a) fraudulent misrepresentation; (b) for death or personal injury arising from our negligence; (c) for breach of any condition as to title or quiet enjoyment of or in relation to any goods supplied by us; (d) in relation to any other liability, including any liabilities under sale of goods or supply of services legislation, that may not be by applicable law excluded or limited.
1.5 Complaints
Wild Poland operates a complaints procedure. Any complaint should be made by e-mail at our address: info@wildpoland.com. We aim to respond to a complaint by e-mail within 14 days.
1.6 Pricing
All prices are displayed in Polish złoty (PLN) on our website and are inclusive of any relevant VAT. The breakdown of VAT can be seen in your shopping cart before purchase. By committing to purchase you are agreeing to pay the price of the goods which may include a differing VAT rate dependent on the goods supplied.
1.7 Discount Coupons
Wild Poland does offer discount coupon redemption on some of our goods supplied. Should the item being purchased already be on sale additional discount will not be applied.
Discount coupons cannot be used in conjunction with any other offer provided by Wild Poland or any other third party cashback offer.
To redeem your discount enter your discount coupon exactly as it appears in the box marked ‘Coupon code’ on the shopping cart or checkout page.
Any discount offered purely applies to the retail price of items in the basket and excludes any additional costs such as postage and packaging. Should you change the items in your shopping cart, the discount will be recalculated accordingly.
2. Conditions of Sale
2.1 Value Added Tax
Unless stated otherwise, all books, e-books (pdf files), maps and bags prices displayed on Wild Poland are inclusive of VAT at the current rate. Delivery cost will be notified to you separately before placing your order at the checkout area of the website.
2.2 Custom Charges
For customers ordering goods for delivery outside of the EU please be aware your order may be subject to import duties and taxes which are levied once the good reach the country of destination. It is accepted that Wild Poland has no control over any such additional charges in relation to customs clearance and all such charges must be paid by you, the customer. Please check with your local customs office if you would like further information on import duties and custom charges for your locality.
2.3 Privacy
Wild Poland and all transactions are governed by the General Data Protection Regulation (GDPR) and relevant Polish data protection laws. Please review our Privacy & cookies policy for further information about using our site and cookie practices. We will use your personal information in accordance with our Privacy policy which forms part of these terms.
2.4 Security of Payment
When you make a payment to us, we do not receive any details of your payment card or your bank account. This information is processed using a third party payment services provider and is not stored by us. Wild Poland uses PayU and PayPal gateways to ensure the highest levels of security are enforced around our payment and order processes so that your personal information and payment details are kept secure.
2.5 Refunds and Returns – printed books, maps and bags
You have a statutory right to a refund on book, map and bag products if for any reason you are unhappy with these products purchased from Wild Poland. You must notify us in writing within the ‘cooling off’ period of fourteen (14) working days of receiving the goods, beginning the day after you receive the goods. You must return your purchase to us and are entitled to a refund of the purchase cost of the goods under the conditions below.
You must notify us in writing, via e-mail and return the goods to us within 21 working days of the delivery of your order.
2.5.1. Order Cancellation
You will then be given a refund of the cost of your goods (and any original postage costs you incurred, if applicable), providing the goods returned are in their original condition and you have taken reasonable care of them whilst in your possession. By including a copy of the original receipt or delivery note this will speed up the processing of your return in our systems. Any cost (return cost) incurred to post the goods back to us will not be refunded to you and is your sole responsibility.
If we delivered the item to you in error or the item is damaged or defective then the cost of return will be met by us and must be accompanied by a return postage receipt.
2.6 Refunds and Returns – e-books supplied via download
Purchased e-book titles cannot be returned, refunded or exchanged. Please be aware that you lose your right to cancel your contract for these services during the cooling off period once we have commenced activation of the electronic download to your device.
If you experience difficulties downloading your purchased e-book please contact us by e-mail at info@wildpoland.com and we will assist you. When purchasing electronic goods you should ensure that you have the appropriate reader for the electronic format you have downloaded. Wild Poland accepts no liability for electronic product downloaded on to an incorrect device.
2.7 Delivery
We deliver the goods ordered by you to the address you provide at the time you create your order on our website. Delivery will be made in accordance with the information on the order pages at the time of placing the order. We are not liable for any delay caused by the unavailability of you to accept the delivery. If there has been a delivery attempt made it will be your responsibility to contact the post office or courier company as soon as possible to arrange collection or re-delivery.
Delivery times are estimated and dependent on availability, printing processes, third party stock dates and delivery companies of foreign operators. We use Polish Post (Poczta Polska) to handle our shipments. For deliveries within the EU and you should allow up to seven (7) working days for delivery from the date you receive your order dispatch confirmation email. For an order being delivered outside of the EU please allow up to twenty-one (21) working days for delivery. Please note that there may be a seasonal variant to these standard times pending postal and courier service workloads. Wild Poland will not be liable for any postal disruption outside of its control.
2.7.1 Non Delivery
In the event that a despatched item(s) is delayed or assumed lost in transit we cannot offer to replace or refund until:
- 20 business days after despatch if the item was sent to the EU or Europe
- 25 business days after despatch if the item was sent to Rest of World.
Wild Poland will hold no liability or responsibility to you unless you notify us within a total of 30 days of the date on which the goods were dispatched to you.
If you notify a problem to Wild Poland, in writing or via e-mail, under this condition we will rectify a shortage on delivery or replace or repair any goods that are damaged or faulty; or refund to you the amount paid by you for the goods in question to the original payment method.
2.7.2 Cancellation by us
We reserve the right to cancel the contract between us if, for example:
- We have insufficient stock to supply your order within 30 days;
- We do not deliver to your area or country;
- One or more of the goods you ordered was listed at an incorrect price due to typography errors or an error in the pricing information received by us from our third party suppliers.
3. Title and Risk
You become the owner of the goods you have ordered when we have received cleared funds in full payment for the goods. Once goods have been delivered to you they will be held at your own risk and we will not be liable for loss, damage or destruction.
4. Force Majeure
Every effort will be made to carry out purchase requests and delivery of goods but Wild Poland shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so, or defect or damage caused in delivery that is caused by any event or circumstance beyond its reasonable control, including, without limitation, strikes, lock-outs and any other industrial disputes, breakdown of systems or network access, flood, fire, explosion.
5. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with Polish Law and subject to the jurisdiction of the courts of Poland.
